Agreement to Terms

By accessing birchandgrain.com or engaging Birch & Grain Custom Cabinetry for services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

Our Services

Birch & Grain designs, manufactures, and installs custom cabinetry in Tampa Bay and greater Central Florida, including:

• Kitchen cabinetry (base, wall, pantry, islands)
• Bathroom vanities
• Custom closets and storage systems
• Outdoor kitchens
• Entertainment units and built-ins
• Custom millwork and bookcases
• RTA (Ready to Assemble) cabinet supply

All services are subject to a separate written agreement, signed proposal, or contract executed prior to commencement of work.

Quotes and Estimates

Consultation requests submitted through our website or by phone are not binding contracts. All quotes are provided in writing and are valid for 30 days from the date issued unless otherwise stated. Prices are subject to change after quote expiration or if project specifications change.

A signed proposal and deposit are required to initiate any project.

Payment Terms

Payment terms are outlined in your individual project agreement. Generally:

• A deposit is required to begin design and manufacturing
• Progress payments may be required on larger projects
• Final payment is due upon project completion or delivery
• Financing options may be available — ask us for details

Birch & Grain reserves the right to pause or terminate work on projects with outstanding balances. Late payments may be subject to interest charges as outlined in your project agreement.

Warranty

Birch & Grain provides a 1-year limited warranty on parts and labor for cabinets we manufacture and install. This warranty covers defects in materials and workmanship under normal residential use conditions.

This warranty does not cover

• Damage caused by misuse, neglect, or improper cleaning products
• Normal wear and tear
• Damage from water, humidity, heat, or environmental conditions beyond our control
• Modifications made by the client or third parties after installation
• RTA cabinets assembled or installed by parties other than Birch & Grain

Service Area

Birch & Grain serves Tampa Bay and greater Central Florida. We do not provide installation services outside of Florida. RTA cabinet supply to customers outside our service area may be possible — please contact us to discuss your project.

Website Use

You may use our website for lawful purposes only. You agree not to:

• Use the site in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any part of our site or systems
• Transmit unsolicited advertising or promotional material
• Reproduce, copy, or distribute our content without written permission

Intellectual Property

All content on birchandgrain.com — including text, images, logos, graphics, and design — is the property of Birch & Grain Custom Cabinetry and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or use our content without prior written permission.

Limitation of Liability

To the fullest extent permitted by law, Birch & Grain shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim related to our services shall not exceed the amount you paid us for the specific service giving rise to the claim.

We make no warranties — express or implied — regarding our website, including warranties of merchantability or fitness for a particular purpose.

Governing Law

These Terms of Service are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services shall be resolved in the courts of Hillsborough County, Florida.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised terms.
